1. The Promoter

1.1. The promoter is: Giveaway Genie, PO Box 376, Hartlepool, TS24 4GL. Registered as a Company in England & Wales #13116122.

2. The Competition

2.1. The title of the competition is: “You Could Win This House for Just £2”

2.2. The Free Draw operated by the Promoter to which these Terms and Conditions apply, wherein the Entrants submit entries via the website or by post to win the Prize.

2.3. The competition mechanics are:

• Obtain the opportunity to win the Main Prize by using skill and judgement to correctly answer a question from the web site to be entered into the Main Prize draw.

• Obtain the opportunity to win the Share Prize by sharing via a URL share link with others and being entered into the Share Prize draw.

2.4. Minimum number of paid entries: 75,000

2.5. Maximum number of paid entries: 500,000

2.6. The competition can be closed when the maximum number of paid entries is reached.

2.7. The opening date for the competition is: Monday 1st February 2021

2.8. The closing date for the competition is: Wednesday 30th June 2021 (at 23:59:59) Free postal entries will be given 3 days grace period to arrive after the close of the draw, with the Live Draw being held on Monday 19th July 2021 (noon)

3. How to Enter

3.1. The competition will run from Monday 1st February 2021 (the “Opening Date”) to midnight on Wednesday 30th June 2021 (the “Closing Date”) inclusive.

3.2. All website competition entries must be received by the Promoter no later than ‘the Closing Date’. Postal entries will be given 3 days grace period to arrive after the close of the draw. All competition entries received after the Closing Date and postal grace period are automatically disqualified. The promoter reserves the right to extend the closing date by 3 months at their discretion and subject to the ‘Minimum number of paid entries’ not being reached.

3.3. The price to enter the competition is £2 per entry and is payable using the website. All entries to the draw are final, no refunds will be given except in the case of entries submitted after the closing date.

3.4. To enter the competition, Entrants must confirm they are over 18 years of age, answer the question from the website correctly and submit the following contact information details requested by the Promotor:

• Valid email address

• Name

• Phone number

3.5. To enter the free draw, the Entrant shall;

• accept the terms and conditions;

• answer the question from the website correctly;

• submit the answer to the question on by 1st class post in writing on a postcard or on plain paper inside an envelope including the Entrants name, telephone number and valid email address. This information needs to be written down in very clear writing otherwise the entry may be deemed invalid.

3.6. All Entrants are solely and completely responsible for providing the Promotor with accurate and current contact details. The Promotor will not be liable for any failure or in ability to make contact with any Entrant due to any errors, omissions or inaccuracies in the contact details provided by the entrant.

3.7. A maximum of one entry can be made per postcard or envelope received.

3.8. Postal entries are treated in exactly the same way as paid entries for the purposes of determining a winner therefore have an equal chance of winning as any one paid entry.

3.9. If a postal entry wins a Prize there will be no further purchase or payment necessary to be notified of the win or to receive the prize.

3.10. The Promoter shall not be liable for or accept:

• responsibility for competition entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware, high internet traffic or software failure of any kind; or

• proof of posting or transmission as proof of receipt of entry to the competition; or

• incomplete entries or failed computer communications or for any loss suffered as a result of use of the website.

3.11. There are no limits to the number of entries that any one person can make to this competition.

3.12. By submitting a competition entry, you are agreeing to be bound by these terms and conditions.

3.13. By entering into the competition all Entrants understand that their payment of £2 per entry does not guarantee in any way that they will win a prize.

4. Eligibility

4.1. The competition is only open to all residents in the UK aged 18 years or over, except:

4.1.1 employees of the Promoter or its holding or subsidiary companies;

4.1.2 employees of agents or suppliers of the Promoter or its holding or subsidiary companies, who are professionally connected with the competition or its administration; or

4.1.3 members of the immediate families or households of (4.1.1) and (4.1.2) above.

4.2. In entering the competition, you confirm that you are eligible to do so and eligible to claim the prize or any prize you may win. The Promoter may require you to provide proof that you are eligible to enter the competition.

4.3. The Promoter will not accept competition entries that are:

• automatically generated by computer;

• completed by third parties or in bulk;

• hacking or interference with the functioning of the website;

• illegible, have been altered, reconstructed, forged or tampered with;

• photocopies and not originals; or

• incomplete entries.

4.4. The Promoter reserves all rights to disqualify or declare an Entrant void, without any refund being given, if conduct is contrary to the spirit or intention of the prize competition, if the Entrant engages in any form of fraud or there are reasonable grounds to believe the Entrant has acted in breach of any of these terms and conditions.

4.5. Competition entries cannot be returned or refunded.

5. The Prizes

5.1. Dependent upon the minimum number of paid entries being met, the prizes are:

• The Main Prize: The advertised house which will be unfurnished; and

• The Share-Prize: Up to £5000 Cash.

• The Charity Donation: Whichever is the larger amount; 75% of retained profit or 10% of the net ticket sales will be paid to the chosen charity.

5.2. Prizes are subject to the minimum number of paid entries being reached by the closing date. If the minimum number of paid entries is not met by the closing date the substitute prizes are:

• Substitute Main prize: 80% of the net profits generated from the paid for ticket sales will be paid to the winner of the Main Draw.

• Substitute Share Prize: 10% of the net profits generated from the paid for ticket sales up to a maximum of £5000 will be paid to the winner of the URL Share Draw.

• Substitute Charity Donation: Whichever is the larger amount; 75% of retained profit or 10% of the net ticket sales will be paid to the chosen charity.

If the campaign fails to get enough entries whereby a ‘reasonable equivalent’ substitute prize could not be provided, we will close the campaign and refund all entries at no cost to any customer.

5.3. The prize is supplied by The Promoter reserves the right to replace the prize with an alternative prize of equal or higher value if circumstances beyond the Promoter’s control makes it necessary to do so.

5.4. The valuation of Main Prize is estimated by owners at £90,000 plus stamp duty, and solicitors’ conveyancing fees (inclusive of the winner’s solicitors’ fees up to a maximum of £1000 +VAT )

5.5. The prize is not negotiable or transferable.

5.6. The Promotor does not guarantee or is responsible or liable in any way for the valuation of the Prize and makes no representation of warranty in respect of its accuracy.

5.7. The Promotor is not responsible or liable in any way for the structural or cosmetic condition of the Prize or the ability for it to be sold. Entrants should attain and depend on their own enquiries and legal advice about the prize before entering the completion.

6. Winners

6.1. The decision of the Promoter is final, and no correspondence or discussion will be entered into.

6.2. The winner of the draw will be the entrant whose details are randomly drawn before an audience of invited guests.. The draw may or may not be live streamed using social media.

6.3. The Promoter will contact the Winner personally as soon as practicable after the Announcement Date, using the telephone number or email address provided with the competition entry. The Promoter will not amend any contact information once the competition entry form has been submitted.

6.4. The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter will publish the surname and town of major prize winners on the website within one month after the Closing Date of the competition. By entering, the Winner agrees to allow the Promotor to display his or her name on the website.

6.5. If you object to any or all of your surname, town and winning entry being published or made available, please contact the Promoter via the email address on the website. In such circumstances, the Promoter must still provide the information and winning entry to the Advertising Standards Authority on request.

6.6. The winner will be required to prove their identity by forwarding a copy of their passport or driving licence, utility bill and valid payment method used to enter the draw.

7. Claiming the Prize

7.1. The Prize will be transferred by the Owner to the Winner of the Contest free from all mortgages, fees, charges, taxes, and other encumbrances, without cost to the Winner

• Please allow a minimum of 6 weeks for the transfer of the house to be completed.

• The Winner shall ensure that the Prize is registered at HM Land Registry in the Winner’s name.

• The Winner will be required to sign a transfer deed to transfer the Property into the Winner’s name within 28 days of Transfer of the Property.

7.2. The prize may not be claimed by a third party on your behalf.

7.3. The Promoter will make all reasonable efforts to contact the winner. If the winner cannot be contacted or is not available or has not claimed their prize within 28 days of the Announcement Date, the Promoter reserves the right to offer the prize to the next eligible Entrant selected from the correct entries that were received before the Closing Date. The alternate Winner shall have 14 days from notification to accept their prize.

7.4. The Promoter does not accept any responsibility if you are not able to take up the prize

8. Limitation of Liability

8.1. Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.

9. Data Protection and Publicity

9.1. The Promoter will only process your personal information as set out in the Privacy Policy of

The Entrants and the Promoter recognise that the Promoter may use contact details and other data including personal data as defined by the Data Protection Act 1998 supplied by the Entrants to the Promoter to administer the Website and conduct the Competition according to these Terms and Conditions, and to contact Entrants regarding similar competitions.

9.3. The Entrants and the Promoter also recognise that the Promoter may (either by choice or at the request of a third party) also disclose this information to relevant third parties for the purposes of the prevention of fraud, money laundering, legal or other financial or regulatory reasons.

10. General

10.1. If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the competition.

10.2. The Promoter reserves the right to hold void, suspend, cancel, or amend the prize competition where it becomes necessary to do so.

10.3. These terms and conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.

10.4. The Entrants and the Promoter recognise that the Competition, its administration and all associated activities are governed by English Law and the Promoter and Entrants recognise that the County or High Courts of England shall have exclusive jurisdiction in the event of any dispute arising out of the Competition or its administration.

10.5. The Promoter reserve the right to amend these terms and conditions at any time and for any reason.

10.6. Each Entrant agrees that the usual requirement under the Consumer Protection (Distance Selling) Regulations 2000 for any goods and services ordered online to be supplied within 30 days will not apply to this Prize Competition.

10.7. The Promoter reserves the right to cancel the Competition at any time either before or after tickets have been sold. If the Competition is cancelled, the Promoter will return the Entry Fees to each Entrant (either by bank card refund or by cheque and in one combined payment where several entries have been made by a competitor). Where the Entry Fee is returned, the Promoter shall have no further liability to the Entrant or to any other person.

10.8. The Promoter accepts no liability for errors or omissions contained within the Prize details, description or specification or any other part of the Website. It is the responsibility of each Entrant (and in particular the Winner) to satisfy him/herself as to the accuracy of any such details and/or any content of this website.

10.9. These competition rules shall not create or be construed as creating any form of contract, joint venture or other agreement between any Entrant and the Promoter. 10.10. Each entrant should retain a copy of these Terms and Conditions for their future reference.
